RC Car HS Code:
9503.00, Not 8526

The Short Answer

A remote control car — assembled or sold as a kit — is classified under HS 9503.00 as a toy. It is not 8526, and in the current Harmonized System it is no longer 9503.50 either; that subheading was consolidated into 9503.00.

It is not classified under 8526 (radio remote control apparatus) even though it contains a transmitter and receiver, and it is not classified under Chapter 85 because it contains electronics. The General Interpretative Rules send a product to the heading that describes what it fundamentally is, and an RC car is played with.

In the US HTSUS the MFN rate under 9503.00.00 is free. Additional Chapter 99 measures for China-origin goods are a separate question — see the section below.

What Falls in 9503.00, and What Falls Outside

What you are importing Heading Why
Ready-to-run RC car, retail boxed9503.00Assembled toy, used as-is
RC excavator, bulldozer, forklift9503.00Construction toy, not a working machine — it carries no load and performs no task
Unassembled scale model kit9503.00Assembly kits sit in the same current subheading; only the national statistical suffix may differ
Spare body shell, gear set, motorOutside 9503Parts are classified on their own material and function, not as the toy
Loose LiPo battery packChapter 85Batteries have their own heading; shipping as a separate line also changes the dangerous-goods declaration

Why you still see 9503.50 in older paperwork: the old subheadings inside heading 9503 — including 9503.50 for reduced-size model kits — were consolidated into a single 9503.00 subheading in the current Harmonized System. CBP rulings from before that consolidation still cite them, and some national schedules that have not been re-based continue to print them. If a supplier's invoice shows 9503.50, the code is not fraudulent, it is simply from an older structure: ask them to re-issue against 9503.00 and confirm the national statistical suffix with your broker.

Why Not 8526 (Radio Remote Control Apparatus)

8526 covers radio remote control apparatus — the transmitter and receiver as equipment. An RC car does contain both, which is why importers occasionally reach for 8526, usually in the belief that a lower rate applies.

Three things go wrong with that argument:

  • The set test. A transmitter plus vehicle put up for retail sale is a set put up for a particular activity, and that activity is play. The set takes the character of the whole, not of the most technical component.
  • The documentation test. The same carton carries a toy safety report and an age marking. A declaration that contradicts the product's own compliance paperwork is an inconsistency examiners look for.
  • The follow-on test. Toys carry toy-market obligations — CPSIA testing, tracking labels. Declaring 8526 does not remove those obligations; it only adds a classification dispute.

Radio compliance is not classification

FCC Part 15 authorisation in the US, or CE-RED in the EU, is required for the transmitter regardless of which tariff heading you declare. Those approvals are separate from customs classification and do not substitute for it. See our RC import guide for what the factory must provide.

The Duty Rate Is Not the HS Code

The HS code gets you to the MFN rate. What you pay can be several layers higher, and those layers sit in Chapter 99 rather than Chapter 95:

  • Chapter 99 additional duties — China-origin actions, amended at short notice. Apply to the origin, not to the product category.
  • Entry fees — merchandise processing fee and harbour maintenance fee, calculated on value and freight.
  • Two shipments, two calculations — a container holding both RC cars and water guns shares the same origin treatment but not necessarily the same Chapter 99 lines.

We do not print a percentage, because the rate that was correct when this page was written will not be correct forever, and a stale number in a ranking page is worse than no number. Confirm the current Chapter 99 treatment for HS 9503.00.00 with your broker, for your entry date.

Do it yourself in three steps: open the current HTSUS and read 9503.00.00 for the MFN rate; search 9903.88 and the newer 9903 entries for whether 9503.00.00 appears in the listed product descriptions; then cross-check against a CBP CROSS ruling for a similar product. All three sources are free.

Documents That Must Match the Declaration

  1. Commercial invoice describing the item as a "remote control toy car, 2.4GHz, model KTxxxxx" — not "electronic toy vehicle" and not "radio control apparatus".
  2. FCC ID or grantee code for the transmitter, where selling into the US.
  3. ASTM F963 or EN71 report for the model and age band.
  4. UN38.3 and MSDS for the battery pack, required by the carrier and independent of customs.
  5. Packing list with carton dimensions and gross weight, matching your freight booking.

Our certifications page separates product testing from factory social audits, and the full HS code guide covers the EU and India structures if you are shipping beyond the US.

Frequently Asked Questions

What is the HS code for a remote control car?

HS 9503.00, whether the car is ready-to-run or sold as a kit — the old 9503.50 subheading was consolidated into 9503.00. In the US HTSUS the MFN rate under 9503.00.00 is free.

Is an RC car classified as radio equipment?

No. Although it contains a transmitter and receiver, the retail set has the essential character of a toy and falls in 9503. Radio compliance such as FCC Part 15 is a separate obligation.

Do spare parts use the same HS code?

No. Body shells, gears and motors are classified on their own material and function, and loose battery packs fall in Chapter 85. Mixing parts into a toy declaration creates a mismatch against the packing list.

Does a 2.4GHz transmitter change the tariff code?

No. The radio band is a compliance issue, not a classification issue. A 27MHz car and a 2.4GHz car sit in the same heading.

Are RC toys duty free in the US?

The MFN rate under 9503.00.00 is free, but Chapter 99 additional duties for China-origin goods and entry fees may apply. Confirm the current treatment with your broker before pricing.
